If you have ever hoped of installing solar panels in your community association, but your request was not approved by the association, it is your lucky day. The passage of AB 634, allows for the installation of solar panels on the common area roof and roofs that are exclusive to the carport or garage in your condominium.

Keep in mind that Civil Code Section 714(b) says that those restrictions cannot significantly decrease the efficiency, by more than 10%, or significantly increase the cost of the installation, by more than $1,000 or 10%. The board must require the unit owner to meet some obligations. They must require that the owner notify everyone in their building that they are applying for solar; and have liability insurance coverage that continues to their successors in interest of protecting the common area.

Although these rules appear to be tedious and restrictive, the intention of them is to protect the common interests of the association. Below are some things that should be kept in mind when choosing to install solar panels in a condominium association:

Roof Survey

A roof survey ensures that all owners receive the same amount of roof space in the event that they hope to install solar panels in the future.

Costs

The homeowner installing the solar panels is responsible for all costs (installation, maintenance, and repair). In addition, removal of the solar panels is the responsibility of the homeowner. In the event that roof repairs have to be done, the homeowner is also responsible for removing the panels in order to allow the vendors to replace the roof. Any damage done to the common area due to the panels are also the responsibility of the owner.

Contractor

Any work (installation, repair, etc.) should be completed by a licensed contractor. A contractor that performs over that is valued at $500 or more (materials, labor, etc.) should hold a current and valid license that applies to the scope of work that they are performing.

Disclosure

The association should be notified and approve the installation of the solar panels to ensure that they follow the California Civil Code. In addition, responsibility for the solar panels should be disclosed on the deed of the property for any prospective buyers.
